General Terms and Conditions (GTC) of Soelva GmbH for the online store

1. general information & scope of application

1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers and entrepreneurs via the online store of Soelva GmbH / Srls.
1.2 Deviating conditions of the customer are not recognized unless they have been expressly confirmed in writing by Soelva GmbH.
1.3 In addition to these GTC, our data protection regulations, shipping conditions and terms of payment apply, which are an integral part of this agreement.

2 Conclusion of contract & ordering process

2.1 The presentation of the goods in the online store does not constitute a legally binding offer, but a non-binding product overview.
2.2 A purchase contract is only concluded when Soelva GmbH either sends an order confirmation by e-mail or delivers the ordered goods.
2.3 The ordering process includes the following steps:

• Selection of the desired products
• Enter billing and delivery address
• Selection of payment method
• Check the order & confirm by clicking on “Buy”
• Confirmation of receipt of the order by e-mail

2.4 The order shall be accepted within three working days at the latest.

3. prices, taxes & shipping

3.1 All prices quoted in the online store are inclusive of VAT.
3.2 Shipping costs are shown separately during the ordering process. Free delivery is available for orders over €200 (within Italy & Germany).
3.3 Deliveries are made to the following countries:

• Italy, Germany, Austria.
• Deliveries to other countries may be subject to additional taxes, customs duties or fees, which shall be borne by the customer.

4. terms of payment

4.1 Payment is made using the following methods:

• Credit card (Visa, Mastercard)
• PayPal
• Bank transfer (prepayment)
• Invoice (only for registered business customers)

4.2 Soelva GmbH reserves the right to carry out a credit check and to exclude certain payment methods.

5. right of withdrawal & returns

5.1 Right of withdrawal for non-perishable goods
Consumers have the right to withdraw from the purchase contract within 14 days of receipt of the goods without giving reasons.

5.2 Exclusion of revocation for food
The right of revocation does not apply to:

• Perishable goods or products with a short shelf life
• Sealed food or drinks that are not suitable for return for hygienic reasons if the seal has been removed

5.3 Revocation declaration & return shipment

• The revocation must be made in writing by e-mail or post to the following address:

• After acceptance of the revocation, the customer will receive a return address.
• The buyer bears the return costs.

5.4 Reimbursement

• The refund will be made within 14 days of receipt of the returned goods at the latest.
• The same means of payment is used for the repayment as for the original transaction.

6. delivery & shipping

6.1 Delivery is made via courier services and is dispatched within 7 working days of order confirmation at the latest.
6.2 Fresh products & chilled goods:

• Products requiring refrigeration are shipped in suitable packaging.
• The warranty for compliance with the cold chain only applies until the first delivery attempt.
  6.3 Transport damage:
• The customer must immediately complain about obvious transport damage to the deliverer and inform Soelva GmbH.

7. reservation of title

The goods remain the property of Soelva GmbH until payment has been made in full.

8 Warranty & Liability

8.1 The statutory warranty rights apply to defects.
8.2 Liability is excluded for:

• Damage due to improper storage or use by the customer
• Force majeure or delivery problems by suppliers

9. protection of minors (sale of alcohol & age verification)

9.1 Alcohol is only sold to persons of legal age (18+ years).
9.2 When placing an order, the customer confirms that he/she has reached the legal minimum age.
9.3 Soelva GmbH reserves the right to carry out an age check (e.g. on delivery).

10. contract text & data protection

10.1 The contract text is saved and the order data is sent by email.
10.2 Further information on data protection can be found in our privacy policy.

11 Complaints, place of jurisdiction & final provisions

11.2 Place of jurisdiction & applicable law

• Italian law shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
• Bolzano is the exclusive place of jurisdiction for any disputes.

11.3 Severability clause
Should any provision of these GTC be invalid, this shall not affect the validity of the remaining provisions.
